GALVESTON – A Texas City woman is seeking damages after her vehicle was struck by an allegedly distracted pizza delivery driver.

Mary Bush filed a complaint on Dec. 21, 2017, in the Galveston County District Court against Curt Casper and Domino's Pizza LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 2, 2016, she was driving a 1998 Chevrolet Trailblazer on FM 1764 when suddenly and without warning her vehicle was struck by Curt, who was in the course and scope of his employment with defendant Domino's Pizza. 

The plaintiff holds Casper and Domino's Pizza LLC responsible because Casper allegedly failed to control the speed of the vehicle, failed to keep proper lookout, failed to yield to the right of way and allegedly drove while using a mobile and/or cellular device.

The plaintiff seeks monetary relief of more than $1 million and such other relief to which she is entitled. She is represented by John D. Pascoe in Webster.
