HOUSTON – Franchise business buyers allege the sellers misrepresented facts about the business in order to induce them to purchase it.
Arturo Henriquez and Ronquito Ventures LLC filed a complaint on Dec. 22 in the Harris County District Court against Ramon Cardenas, Larissa Cardenas and Moan LLC alleging fraudulent misrepresentation.
According to the complaint, the plaintiffs purchased a Critter Control franchise business in November 2016 from the defendants. The plaintiffs allege the defendants misrepresented facts about the business, including falsifying warranty information. The plaintiffs allege that the defendants' denial and/or failure to handle warranty claims have resulted in a loss of business.
The suit states the plaintiffs seek rescission of the agreement.
The plaintiffs seek judgment against defendants with interest and all other relief to which they may show themselves justly entitled. They are represented by C. Scott Kinzel and Chester J. Makowski of Plavnicky Kinzel Makowski LLP in Houston.
