Business owner faults financial consultant for failing to properly file tax returns

HOUSTON – A business owner is suing his financial consultant for failing to properly file tax returns, per recent Harris County District Court records.

Khaled Momtaz filed a lawsuit against Charles Pettway and his firm, Pettway Management Consultants, L.L.C., in the Harris County 333rd District Court on Dec. 29, claiming the defendants did not file returns on behalf of BePlused.com, L.LC. for tax years 2012 through 2015.

 Momtaz, who founded BePlused in 2011, asserts the respondents knew or should have known that returns prepared for 2012 through 2015 were not filed or, when filed, were rejected by the Internal Revenue Service.

“The defendants’ failure to exercise reasonable care in his practice of tax preparation has caused the plaintiff to be assessed penalties by the IRS,” the suit says.

Consequently, Momtaz seeks unspecified monetary damages and a jury trial.

Attorney Cheryl F. Coleman of the law firm Coleman & Associates in Houston is representing the complainant.
