Shopper alleges chair at At Home Group Inc. store caused injuries

HOUSTON – A Brazoria County woman alleges she was injured at a store when the chair she sat in gave way and caused her to fall.

Eva Iniesta filed a complaint on Jan. 4 in the Harris County District Court against At Home Group Inc. and At Home Stores LLC alleging premises liability.

According to the complaint, the plaintiff alleges that on Dec. 16, 2017, she was shopping at the defendants' store when the chair she was attempting to sit in gave way, causing her to fall. She alleges she sustained serious injuries that resulted in pain and suffering, mental anguish, medical expenses and lost wages. 

The plaintiff holds At Home Group Inc. and At Home Stores LLC responsible because the defendants allegedly failed to provide warning signs that the chair was defective and dangerous.

The plaintiff requests a trial by jury and seeks actual and special damages, pre- and post-judgment interest, costs of court and such other legal and equitable relief. She is represented by David K. Mestemaker, Norman Straub, Van Gardner and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
