GALVESTON – An African-American woman alleges she was terminated from her job at a Wal-Mart distribution center because of her race and sex.

Crystal Vallery filed a complaint on Jan. 16 in the Galveston Division of the Southern District of Texas against Wal-Mart Associates Inc., Wal-Mart Stores East LP and WalMart Inc. alleging that they violated Title VII of the Civil Rights Act.

According to the complaint, the plaintiff began working for the defendants in 2009 at their Baytown distribution center and was area manager at the time of her termination. She alleges she reported the discriminatory conduct of a male manager and no actions were taken.

The suit states an associate that worked with the plaintiff was terminated on allegations of misusing company time in July 2016. The plaintiff alleges that she was contacted about the associate by the general manager and later terminated July 5, 2016, on allegations of misconduct in supervising the associate. She alleges she was terminated because of her sex, race and in retaliation for her discrimination complaints.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, back and front pay, attorney’s fees, court costs, pre- and post-judgment interest and such other and further relief. She is represented by Bruce A. Coane and Matthew P. Swiger of Coane & Associates PLLC in Houston.
