Union Pacific Railroad electrician alleges negligence caused injuries at Harris County yard

HOUSTON –  An electrician for a common carrier by rail alleges he was injured by locomotives while working in Harris County.

Earnest Jones filed a complaint on March 1 in the Harris County District Court against Union Pacific Railroad Co. alleging Federal Employers Liability Act negligence

According to the complaint, the plaintiff alleges that on March 3, 2015, he was injured while in the course scope of his employment with the defendant at Settegast Railyard when he was struck by a runaway of at least seven locomotives. He alleges he suffered severe, painful and permanent injuries to his shoulders, upper extremities and back. 

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to replace the defective ground relay on a locomotive and failed to provide proper training and supervision to employees on the proper handling of locomotives.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other general and special relief. He is represented by Stephen M. Fernelius and Ryan M. Perdue of Fernelius Simon PLLC in Houston and C. Marshall Friedman and Mark J. Becker of The Hullverson Law Firm in St. Louis, Missouri.
