BEAUMONT – The trial of a medical malpractice lawsuit over the use of the da Vinci Surgical System, a robotic device used to assist surgeons, ended with the jury finding no negligence was committed by the defendant nor the plaintiff.
Reagan Corbello filed suit against Southeast Texas OB/GYN Associates and Dr. Ruben Victores on Sept. 10, 2015 in Jefferson County District Court.
The case was called up for trial on March 19.
According to the lawsuit, on Sept. 18, 2013, two years prior to filing the lawsuit, Corbello was scheduled for a hysterectomy. Victores used the da Vinci Surgical System, even though Corbello allegedly presented with risk factors that the system specifically warns against.
Court records show Corbello had previously undergone obesity surgery and weighed 300 pounds at the time of her visit to Victores.
She faulted the surgeon for failing to select the most appropriate surgical procedure.
However, when the jury was asked to assign negligence to the parties, jurors found no fault with either party and awarded no damages as a result.
Corbello had asked jurors to award her damages for her past mental anguish, impairment, medical expenses and lost wages.
