TXSG member says companies terminated him for fulfilling post-Harvey military obligation

HOUSTON – An active member of the Texas State Guard, Army Branch says he was terminated from his civilian job because he reported for Hurricane Harvey-related duty.

Keith Ross brought a lawsuit against Apex Systems, L.L.C. and McKesson Corp. on Mar. 22 in the Harris County 190th District Court, alleging discrimination due to his military status.

The defendants hired Ross last June on an 18-month contract to McKesson’s information technology department with Office 365 migration.

Harvey made landfall along the Upper Texas Gulf Coast two months later. Gov. Greg Abbott issued TXSG Order 250-05 on Sept. 7, 2017, activating the defense force to provide post-storm support.

Ross explains he informed his employers about his ordered deployment and went on his nearly two-week mission, stating he was terminated the day after his release from duty.

Consequently, the plaintiff seeks unspecified monetary damages.

He is represented by Nathan E. Inurria and George K. Farah of the law firm Guerra & Farah, PLLC in Houston.
