Huntsville man alleges error on AT&T account wasn't updated on credit report

HOUSTON – A Huntsville consumer alleges an account with a telecommunications company was inaccurately reported as having an outstanding balance.

Lawrence J. Benson II filed a complaint on May 29 in the Houston Division of the Southern District of Texas against AT&T Corp, Diversified Consultants Inc. and Trans Union LLC alleging violation of the Fair Debt Collection Practices Act and the Fair Credit Reporting Act.

According to the complaint, the plaintiff closed his account for television and internet services with AT&T in 2015 and that AT&T reported in error that the plaintiff owed an outstanding balance of $1,200. The plaintiff alleges he disputed the balance with AT&T and that AT&T agreed it was reported in error and directed the credit reporting agencies to delete the tradeline.

The plaintiff alleges in March 2017, AT&T transferred the account to Diversified Consultants for collection. He alleges the account remained on his credit report until December 2017.

The plaintiff holds AT&T Corp, Diversified Consultants Inc. and Trans Union LLC responsible because the defendants allegedly failed to conduct a reasonable investigation.

The plaintiff requests a trial by jury and seeks actual, statutory and punitive damages; costs and attorney’s fees; and such other and further relief as may be just and proper. He is represented by Trista M. Johnson of Law Office of Trista Johnson in Conroe.
