BEAUMONT – Jefferson County parents allege that their minor child was injured during delivery at a Port Arthur hospital because of the use of a vacuum extractor.

Lisa Priscella Gutierrez and Khoa Thien Nguyen, individually and as next friend of LTN, a minor, filed a complaint on May 25 in the Jefferson County District Court against Joe Wesley Ramsey MD and Medical Center of Southeast Texas alleging negligence.

According to the complaint, the plaintiffs allege that on March 15, 2016, LTN was born under the care of defendants. The suit states that as a result of defendants' negligence, the minor child suffered a stroke likely during delivery, causing mental and physical injuries that are lasting and permanent in nature. They allege the stroke was caused by the use of a vacuum extractor during delivery.

The plaintiffs hold Ramsey and Medical Center of Southeast Texas responsible because despite having no complications and having no need to use vacuum extraction during delivery process, defendant Ramsey allegedly blatantly disregarded Gutierrez's direction not to use vacuum extraction during delivery.

The plaintiffs request a trial by jury and seek monetary relief of more than $1 million and such other and further relief to which they are justly entitled. They are represented by Craig Lewis and Aaron J. Arenas of The Lewis Law Firm in Houston.
