Mexican airline faces breach of contract suit for canceling flight to destination wedding

HOUSTON – A Mexican airline faces a breach of contract lawsuit from a Harris County man.

In the suit filed on June 7 in the Harris County 295th District Court, Antonio Padua accuses ABC Aerolineas, Inc., doing business as Interjet, of “completely canceling the flight that was the subject of the agreement” between the parties.

Court documents explain Padua and the company recently entered into a contract in which the latter would fly 50 passengers directly from Houston to Leon, Mexico on Nov. 1, 2018 to celebrate Padua’s wedding and return three days later.

Padua reportedly paid a full deposit of approximately $9,627.25 by the due date in accordance to the subject agreement.

Last month, the airline emailed the plaintiff stating the Houston-Leon leg was canceled though the original petition says the contract did not have “any provision regarding the possible change or cancellation of the flight.”

Per Padua, the respondent offered alternative flights which increased the travel time and costs.

Consequently, the complainant seeks unspecified monetary damages and a jury trial.

He is represented by Sara E. Padua and Alejandro L. Padua of the Padua Law Firm, PLLC in Houston.
