Jefferson County man alleges insurance company failed to act on Harvey claim in 60 days

BEAUMONT – Jefferson County resident alleges his insurer failed to take action regarding this claim for property damage from Hurricane Harvey in a timely manner.

Franco Cruz filed a complaint on May 29 in the Jefferson County District Court against Texas Windstorm Insurance Association alleging breach of contract.

According to the complaint, the plaintiff alleges that in August 2017, Hurricane Harvey damaged plaintiff's insured property, which was covered under a policy issued by the defendant. He alleges that he filed a claim and that the defendant failed to accept or deny coverage within 60 days as required by the Texas Insurance Code.

The plaintiff seeks all damages, interest, attorney's fees, costs and all other relief to which he may show himself justly entitled. He is represented by Aaron Bender and Richard D. Daly of Daly & Black PC in Houston.
