Baytown property owners allege work was not done in workmanlike manner by Magicfish, Ethicus Construction

HOUSTON – A Baytown couple is seeking damages from two companies over allegations renovations they performed on their property breached the construction contract.

Kevin Kelley and Paige Kelley filed a complaint on June 11 in the Harris County District Court against Magicfish LLC, Don Fletcher, Ethicus Construction LLC and J.C. Walker alleging breach of contract and other counts.

According to the complaint, on Aug. 17, 2017, Kevin Kelley entered into a written contract with Ethicus and Magicfish to remodel the plaintiffs' homestead located at 428 Willow Lane in Baytown. 

The plaintiffs hold Magicfish LLC, Fletcher, Ethicus Construction LLC and Walker responsible because the defendants allegedly failed to complete work in a good and workmanlike manner.

The plaintiffs seek monetary relief of more than $100,000 but less than $200,000 and such other and further relief to which they are entitled. They are represented by Leonard E. Cox in Seabrook.
