HOUSTON – A former delivery driver for a Texas corporation alleges she and other drivers were not compensated for the overtime hours they worked.

Audria Bleeker, individually and on behalf of all others similarly situated, filed a complaint on June 12 in the Houston Division of the Southern District of Texas against MKN Worldwide Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendant as a delivery driver in periods in 2015, 2017 and 2018. She alleges she regularly worked in excess of 40 hours per week for most weeks and did not receive overtime wages. She alleges that she was paid on a day-rate basis instead.

The plaintiff holds MKN Worldwide Inc. responsible because the defendant allegedly failed to pay the required overtime premium for those hours worked in excess 40 hours.

The plaintiff requests a trial by jury and seeks to recover unpaid overtime compensation, liquidated damages, plus interest, attorney’s fees, costs and such further relief as the court deems just and equitable. She is represented by Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
