HOUSTON – A contractor is alleged to have failed to provide services as outlined in a contract.

Melquis G. Herrera filed a complaint on June 13 in the Harris County District Court against Maintenance & Construction Services Inc. alleging fraud, breach of contract, negligence and other counts.

According to the complaint, the plaintiff alleges that on Oct. 4, 2015, defendant agreed to provide architectural design and engineering services to plaintiff's proposed concrete plant for $27,500. The suit states the following month, a deal was also reached between the parties for the purchase of a used metal building for $31,000.

The plaintiff alleges that the defendant never provided the services for the plant as contracted and delivered the metal building but never erected it.

The plaintiff seeks actual damages of $36,750, exemplary damages of $109,500, plus interest, attorney's fees, costs and all further relief to which he is entitled. He is represented by Kenneth D. Baugh in Houston.
