Amazon contract service provider Hass Interests alleged to have failed to pay drivers overtime

HOUSTON – A former delivery driver for an Amazon contract service provider alleges he is owed unpaid overtime wages.

Joseph Griffin, individually and on behalf of all others similarly situated, filed a complaint on June 14 in the Houston Division of the Southern District of Texas against Hass Interests LLC and Samm Wiggins Jr. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Nov. 27, 2017, and May 17, 2018, he regularly worked more than 40 hours per week for the defendants without receiving overtime compensation. The suit states that instead he was paid on a day-rate basis for each day worked. 

The plaintiff holds Hass Interests LLC and Wiggins Jr. responsible because the defendants allegedly failed to compensate their delivery drivers at a rate no less than one-and-one-half times their regular rate of pay for each hour worked in excess of 40 in a week.

The plaintiff requests a trial by jury and seeks an order declaring this action as a collective action, appointing plaintiff and his counsel as representatives, award for unpaid overtime wages, liquidated damages, attorney’s fees, costs and such other just and proper relief.
