HOUSTON – Claiming she purchased a defective vape pen, Harris County resident Melody DeBraux has sued the device’s purported manufacturer.
A lawsuit filed on June 21 in the Harris County 333rd District Court says that Digirettes, Inc. sold DeBraux a product which exploded in her mouth last month.
The plaintiff adds she was following instructions, but she suffered injuries which cost her “potential business opportunities.”
Court papers fault Digirettes for negligence.
“A properly designed and manufactured vape pen should not explode in the user’s mouth,” the original petition says. “The defendant’s vape pen did.”
Consequently, DeBraux seeks unspecified monetary damages.
She is represented by Thomas M. Valega, Jr. of Houston.
