HOUSTON – A Houston-based recycling company is alleged to have failed to pay its drivers for the overtime hours they worked.

Harvey L. McCall, individually and on behalf of all others similarly situated, filed a complaint on June 25 in the Houston Division of the Southern District of Texas against Wright Waste Management LLC and Becky Wright alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between November 2017 and June 2018, he consistently worked more than 40 hours per week for the defendants without receiving overtime compensation. He alleges he was instead paid on a salary basis.

The plaintiff holds Wright Waste Management LLC and Becky Wright responsible because the defendants allegedly failed to pay overtime premiums for employees work in excess of 40 hours per week.

The plaintiff seeks to recover overtime compensation, liquidated damages, attorney’s fees, litigation costs and expenses, interest and such other and further relief as the court may find proper. He is represented by Douglas B. Welmaker of Welmaker Law PLLC in Austin.
