ABM Industries faces assault and battery suit from female employee

HOUSTON – Harris County resident Juventina Lopez is suing her employer in response to alleged assault and battery at the hands of her superior, recent local state district court records show.

Lopez’s lawsuit, which was filed on June 25 in the Harris County 129th District Court, blames ABM Industries, Inc. for the subject event last Feb. 5 in which Daniel Rincon attacked the plaintiff.

According to the original petition, Lopez was performing janitorial work when Rincon approached her and “asked under false pretenses to accompany him to an unoccupied area of the office building.”

“Once alone, Mr. Rincon assaulted and battered the plaintiff,” the suit says.

Lopez further states that the events of Feb. 5, 2018 “did not come as a surprise to ABM, asserting the company “was aware of similar allegations of assault” against Rincon but spared him from any discipline.

A vice-principal with ABM, Rincon joins the business as a co-defendant.

Consequently, the plaintiff seeks unspecified monetary damages and a jury trial.

She is represented by J. Moises Cedillos of the Cedillos Law Firm, PLLC in Houston.
