HOUSTON – Two Magnolia residents allege a debt collector continued to call them after they requested the calls to stop.
Edmund H. Hofmann and Tamara A. Hofmann filed a complaint on June 28 in the Houston Division of the Southern District of Texas against Synchrony Financial, doing business as Lowe's Credit Center, alleging violation of the Telephone Consumer Protection Act and the Texas Debt Collection Act.
According to the complaint, the plaintiffs allege that, in early 2018, they began receiving calls to their cellular phone from defendant seeking to collect upon an alleged debt. They allege the instructed the defendant to stop contacting them but the calls have continued.
The plaintiffs hold Synchrony Financial responsible because despite plaintiffs demand to stop contacting them, the defendant continued to relentlessly call their cellular phone several times during the same day and made calls using an automatic telephone dialing system.
The plaintiffs request a trial by jury and seek damages of at least $500 per phone call, treble damages, costs and reasonable attorney fees and such other and further relief as this court deems just and appropriate.
