Former TIEC inspector alleges he is owed unpaid overtime

HOUSTON – A Harris County company is alleged to have failed to pay an inspector overtime compensation.

Karl Spasic, individually and on behalf of all others similarly situated, filed a complaint on June 29 in the Houston Division of the Southern District of Texas against TIEC Inc. and Edward Durante, alleging that violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he routinely worked for defendant in excess of 40 hours per week without receiving overtime compensation for all hours worked in excess of 40 per workweek. He alleges he was initially paid overtime when he began his employment with the defendants in August 2011, but this stopped when his pay was changed to salary in 2014. The suit states the plaintiff stopped working for the defendants in May.

The plaintiff holds TIEC Inc. and Durante responsible because the defendants allegedly paid inspectors on a salary basis without regard for any overtime hours worked.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, interest, costs, attorneys’ fees and such other and further relief to which they may show themselves justly entitled. He is represented by Clayton D. Craighead of The Craighead Law Firm PLLC in Houston.
