HOUSTON – An Angleton man alleges a hostile work environment at a Freeport facility forced him to retire.
Jeffery Henry filed a complaint on July 2 in the Houston Division of the Southern District of Texas against Dow Chemical Co. alleging that the multinational corporation violated the Texas Commission on Human Rights Act and the Texas Labor Code.
According to the complaint, the plaintiff began working for the defendant in 1999 and was transferred to the Freeport facility in 2013. He alleges in 2015, new management was hired at the facility and he alleges he was then subjected to emotional and physical abuse and racial epithets. He alleges that as a result of the intolerable work environment, plaintiff fell ill and was diagnosed with anxiety disorder and worsening mental health condition.
He alleges because of the working environment, he was forced to retire in March.
The plaintiff holds Dow Chemical Co. responsible because the defendant allegedly refused to provide reasonable accommodation, failed to take remedial action and constructively terminated him in retaliation for his complaints of discrimination.
The plaintiff requests a trial by jury and seeks all damages and legal fees, costs and expenses, plus interest and such other and further relief to which he may be entitled. He is represented by Alfonso Kennard Jr. and Laura Krzesienski of Kennard Richard PC in Houston.
