HOUSTON – A worker alleges he was injured after a fall on an uncapped piece of rebar at a Houston job site.

Joaquin Cruz filed a complaint on July 3 in the Harris County District Court against the defendants alleging Blackwell Plastics Inc., Champs Sitework Inc., et al. alleging negligence.

According to the complaint, the plaintiff alleges that on July 23, 2016, he was working for the defendants and was injured after a fall onto an uncapped piece of rebar. He alleges it was the defendants' responsibility to cap the rebar.

He alleges he suffered injuries to his scrotum, physical pain, mental anguish, disfigurement, lost wages and medical treatment expenses as a result of the fall. 

The plaintiff holds Blackwell Plastics Inc., Champs Sitework Inc., et al. responsible because the defendants allegedly failed to provide safety equipment and failed to properly train and supervise their employees.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and all further relief as the court deem justified. He is represented by M. Paul Skrabanek and Betty Feng of Pierce Skrabanek PLLC in Houston.
