SHERMAN – A consumer alleges a home protection plan provider called him 50 times for telemarketing purposes.
Dimitrios Georgakakis filed a complaint on July 6 in the Sherman District of the Eastern District of Texas against CHW Group Inc., doing business as Choice Home Warranty, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that after the home warranty he purchased from defendant expired, the defendant continuously called his cellular phone asking him to sign another contract. He alleges he requested the defendant stop calling but it did not honor his request.
The plaintiff holds CHW Group Inc. responsible because despite his repeated request to stop calling him, the defendant continued to place calls to his cellular phone using an automated telephone dialing system and/or artificial or prerecorded voice.
The plaintiff seeks actual, statutory, treble and punitive damages, and such other and further relief that are proper and just. He is represented by Joshua R. Kersey of Morgan & Morgan PA in Tampa, Florida.
