Nova HealthCare alleged to owe employee unpaid overtime wages

TYLER – A Houston-based professional association is alleged to have failed to pay a Smith County woman the appropriate rate for overtime work.

Alma Valle, individually and on behalf of all others similarly situated, filed a complaint on July 9 in the Tyler Division of the Eastern District of Texas against Nova HealthCare PA, doing business as Nova Medical Centers, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendant at its Tyler facility. She alleges that she regularly worked more than 40 hours per week but was not paid overtime wages at the correct rate.

The plaintiff holds Nova HealthCare PA responsible because the defendant allegedly misclassified her as an exempt employee and failed to pay her at a rate of one-and-one-half times her regular rate for all hours worked in excess of 40 hours in a workweek.

The plaintiff requests a trial by jury and seeks unpaid wages, liquidated damages, court costs, attorneys’ fees; and such other and further relief as the court deems just.
