Bill Wyly Development alleges it is owed more than $20,000 for home construction

GALVESTON – A Galveston County contractor alleges it was not paid in full for the construction of a new home.

Bill Wyly Development Inc. filed a complaint on July 9 in the Galveston County District Court against the defendants alleging failure to pay.

According to the complaint, the plaintiff alleges that on June 2, 2014, it entered into a contract with the defendants to provide labor and materials for the construction of a new residence at 1654 Windsong in the Village of Tiki Island for $468,269. After all adjustments and/or offsets, the defendants allegedly still owe plaintiff the sum of $23,784. 

The plaintiff holds Leroy Hermes and Barbara Hermes responsible because the defendants allegedly wrongfully failed and refused to make payments for the amounts due.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less and non-monetary relief all within the jurisdictional limits of the court. It is represented by Thomas W. McQuage of Galveston.
