Capital Accounts alleged to have threatened man on collection call

HOUSTON – A consumer alleges a debt collector ignored his requests to stop calling him and threatened him with jail time on one call.

Chad R. Heunernund filed a complaint on July 10 in the Houston Division of the Southern District of Texas against Capital Accounts LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in September 2017, defendant acquired his medical debt while it was in default and began placing collection calls to his cellular phone. Due to defendant's nonstop barrage of calls, the plaintiff alleges he has suffered emotional distress, anxiety, loss of concentration and increased usage of his telephone services. 

The plaintiff holds Capital Accounts LLC responsible because despite his request to stop calling him, the defendant continued to place multiple calls to his cellular phone using a predictive dialing system and even threatened him with jail time on one call.

The plaintiff requests a trial by jury and seeks actual and punitive damages, costs and attorney fees and any other relief as the court deems just and proper. He is represented by Alexander J. Taylor, Marwan R. Daher and Omar T. Sulaiman of Sulaiman Law Group LTD in Lombard, Illinois.
