$50 million sought from Sparkletts Water, driver over fatal collision with bicyclist

HOUSTON – The widow and adult children of a bicyclist struck and killed in Houston are seeking damages from the driver and his employer.

Marcia Paulhus, individually and as executrix of the estate of Timothy Paulhus, deceased; Scott Paulhus; and Kelsey Paulhus filed a complaint on July 10 in the Harris County District Court against DS Services of America Inc., doing business as Sparkletts Water, and Roderick Sonnier alleging negligence.

According to the complaint, the plaintiffs allege that on Nov. 25, 2017, Timothy Paulhus was on his bicycle traveling in the 18500 Block of Catamaran Drive in Houston when defendant Sonnier struck him with the commercial truck owned by defendant DS Services, causing fatal injuries. The suit states Timothy Paulhus died four hours later at Memorial Hermann Hospital.

The plaintiffs hold DS Services of America Inc. and Sonnier responsible because defendant Sonnier negligently worked in excess of the hours allowed by law, disregarded the traffic signal, failed to yield to the right of way and failed to keep a proper lookout.

The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally, in the amount of no more than $50 million, plus interest, costs and such other and further relief to which they are entitled.
