Owner of Houston town house alleges water penetration issues caused by contractor's negligence

HOUSTON – The Pearland general contractor of a Houston town house is alleged to have failed to prevent water from entering the property.

Claude Bergeron filed a complaint on July 11 in the Harris County District Court against Randolph Nelson MD alleging that the general contractor violated the Residential Construction Liability Act.

According to the complaint, the plaintiff alleges that in 2010, the defendant sold the plaintiff a town house located at 11 Hyde Park Unit A in Houston. The plaintiff alleges the defendant failed to properly apply stucco and waterproofing to the property, which resulted in water penetration.

As a result of the defendant's alleged negligence, the plaintiff alleges his property was damaged by water penetration and he was required to hire professionals to repair the defects that have been present in the property since construction. 

The plaintiff holds Nelson responsible because the defendant allegedly failed to waterproof the home correctly and prevent the invasion of water into living spaces.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 but less than $1 million and such other and further relief to which he is entitled. He is represented by Lance Winchester, Joseph H. Centrich and Elaine Berkeley of Clausen & Centrich PLLC in The Woodlands.
