MARSHALL – A tractor-trailer driver is seeking damages from a Tennessee trucking company over a fatal collision on Interstate 20.

Robert Miller filed a complaint on July 16 in the Marshall Division of the Eastern District of Texas against Colonial Freight Systems Inc. alleging negligence and negligent hiring.

According to the complaint, the plaintiff alleges that on Jan. 4, he was operating a tractor-trailer on Interstate 20 in Harrison County and was stopped because of traffic. He alleges Jimmy Crisenberry, an employee of Colonial, collided with the rear of his vehicle while driving a Colonial tractor-trailer. The suit states Crisenberry and his passenger were both killed as a result and the plaintiff was injured.

The plaintiff holds Colonial Freight Systems Inc. responsible because Crisenberry allegedly failed to maintain a safe distance, failed to keep a proper lookout and drove while distracted.

The plaintiff requests a trial by jury and seeks special damages of more than $75,000, prejudgment and post-judgment interest, costs of suit and such other and further relief as the court deems just and reasonable. He is represented by Neil Solomon of Zinda Law Group PLLC in Austin.
