ProPoint Solutions did not pay for overtime work, installer alleges

GALVESTON – A former installer for a company who provides software for salon owners and businesses alleges she is owed unpaid overtime pay.

Diana Miller filed a complaint on July 16 in the Galveston Division of the Southern District of Texas against ProPoint Solutions LLC and Rajesh Mahajan alleging that the employers violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she regularly worked 50 to 70 hours per week for the defendant without receiving overtime wages. 

The plaintiff holds ProPoint Solutions LLC and Mahajan responsible because the defendant allegedly willfully or recklessly disregarded the overtime provision of the FLSA by failing to pay overtime wages at a rate of time-and-one-half of her regular rate for the additional work.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, an equal amount as liquidated damages, with interest, attorney’s fees, costs and expenses and such other and further relief as may be permitted by law.
