Spring residents seek damages from Houston Chronicle over alleged telemarketing calls

BROWNSVILLE – Three Spring residents are suing a newspaper over allegations it invaded their privacy with telemarketing calls to solicit newspaper subscriptions.

Richard and Betty Stalons and Darren Deleon filed a complaint on July 16 in the U.S. District Court for the Southern District of Texas against Houston Chronicle, et al. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that between July 15, 2014, and July 14, 2015, they received 12 unauthorized calls from defendant attempting to solicit a newspaper subscription. They allege their phone number has been registered on the National Do-Not-Call Registry since 2012.

The plaintiffs hold Houston Chronicle, et al. responsible because the defendants allegedly made calls using and autodialer and pre-recorded voice message.

The plaintiffs request a trial by jury and seek statutory damages of $500 for the first call and $1,500 for the succeeding calls made as willful, with interest, attorney's fees, costs and such other and further relief that are just and proper. They are representing themselves.
