Pathologist files age discrimination suit against Texoma Medical Center over termination

SHERMAN – A speech-language pathologist alleges her age was a factor in her termination from a medical facility.

Kathryn L. Barker filed a complaint on July 17 in the Sherman District of the Eastern District of Texas against UHS of Texoma Inc., doing business as Texoma Medical Center, alleging violation of the Age Discrimination in Employment Act and other counts.

According to the complaint, the plaintiff alleges that on Aug. 11, 2017, she was discharged after more than 20 years of employment with the defendant at the age of 58. She alleges she was replaced by a recent college graduate in her 20s.

The suit states before her termination, she took a brief medical leave in 2016 and another in 2017.

The plaintiff holds UHS of Texoma Inc. responsible because the defendant allegedly discriminated against her on the basis of her disability or perceived disability and age and retaliated against her for taking FMLA leave.

The plaintiff requests a trial by jury and seeks actual and punitive damages, with interest, attorney’s fees, costs of court and any and all further relief to which she may show herself justly entitled. She is represented by Ronald R. Huff in Sherman.
