BEAUMONT – A patron of a Beaumont restaurant alleges he was injured when part of the ceiling and an opossum fell on him at the premises.

Martin Tenorio filed a complaint on July 18 in the Jefferson County District Court against 10 De Mayo Mexican Grill and Bar LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 5, 2017, he was a customer at defendant's premises in Beaumont when a portion of the ceiling and an opossum fell and struck him in the shoulder. He alleges he sustained severe injuries to his head, neck, back and other parts of his body as a result.

The plaintiff holds 10 De Mayo Mexican Grill and Bar LLC responsible because the defendant allegedly failed to inspect the premises and failed to warn of the dangerous condition.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 but less than $200,000 and such other and further relief to which he may be entitled. He is represented by Swetha Sajja and John A. Daspit of Daspit Law Firm in Houston.
