United Check Recovery Bureau alleged to have falsely represented suit had been filed against Grimes County man

HOUSTON – A Grimes County consumer alleges a debt collector falsely represented that a lawsuit had been filed against him over an alleged debt.

Mark Gremillion filed a complaint on July 18 in the Houston Division of the Southern District of Texas against United Check Recovery Bureau Inc. and Michael Hope alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff allegedly incurred a debt that went into default and was assigned and/or transferred to the defendants for collection by the original creditor. The plaintiff alleges he requested that the defendants cease communication with him but they continued to call him.

He also alleges that the defendants falsely represented that they had filed a lawsuit against him and failed to inform him that they were a debt collector in communications.

The plaintiff requests a trial by jury and seeks actual and exemplary damages, statutory damages of $1,000, attorney's fees and costs and such other and further relief as the court deems just and proper. He is represented by Jeffrey D. Wood of The Wood Firm PLLC in Little Rock, Arkansas.
