Former Legacy Granite & Marble workers allege they are owed unpaid overtime wages

HOUSTON – A Houston company is alleged to have failed to pay two former employees the correct rate for overtime work.

Margarito Sibrian Alfaro and Orlando Guevara filed a complaint on July 19 in the Houston Division of the Southern District of Texas against Legacy Granite & Marble Co. Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, Alfaro was employed by the defendant from July 2010 to February 2018 and Guevara was employed by the defendant from May 2016 to November 2017. The plaintiffs allege that they regularly worked more than 40 hours per week for the defendant without receiving overtime compensation. 

The plaintiffs hold Legacy Granite & Marble Co. Inc. responsible because the defendant allegedly permitted them to work in excess of 40 hours per week but refused to compensate them their proper overtime compensation at the rate of time-and-one-half of their regular rate of pay.

The plaintiffs request a trial by jury and seek all unpaid overtime wages, liquidated damages, attorneys’ fees, costs, and expenses, prejudgment and post judgment interest and such other relief as to which they may be entitled. They are represented by James M. Loren and George Z. Goldberg of Goldberg & Loren PA in Dallas.
