Consumer alleges Alltran Financial unlawfully threatened legal action

HOUSTON – A Houston debt collector is alleged to have unlawfully threatened legal action against a consumer over an alleged debt she claims is in error.

Svetlana V. Poroshina filed a complaint on July 26 in the Houston Division of the Southern District of Texas against Alltran Financial LP alleging violation of the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in June, she began receiving calls to her cellular phone from the defendant seeking to collect upon a debt allegedly owed to Toyota Financial Services. She alleges she was confused by the calls as she had never received any correspondence from the defendant and told it the subject debt was in error.

The suit states the defendant called her employer and disclosed information regarding the alleged debt to her employer and co-workers and threatened her with legal action. She alleges she instructed the defendant to stop calling her but the calls have continued.

The plaintiff holds Alltran Financial LP responsible because the defendant allegedly used deceptive means to collect or attempt to collect an alleged debt.

The plaintiff requests a trial by jury and seeks damages of at least $500 per phone call and treble damages, costs and attorney fees and any other relief as the court deems just and appropriate.
