Scott Thomas Construction worker alleges injuries after co-worker struck him with excavation machine

GALVESTON – An employee of a Galveston County construction company alleges he was injured while laying pipe at a job site when another employee struck him on the head with a machine.

Misael Requena Leon filed a complaint on July 30 in the Galveston County District Court against S Thomas Construction LLC, doing business as Scott Thomas Construction LLC, and Jorge Rodriguez alleging negligence.

According to the complaint, the plaintiff alleges that on June 12, he was in the course and scope of his employment with defendant S Thomas when he was struck in the head by the excavation machine operated by defendant Rodriguez, a co-employee. He alleges he sustained serious and permanent injuries resulting in pain, mental anguish, disfigurement, disability, medical expenses and lost wages. 

The plaintiff holds S Thomas Construction LLC and Rodriguez responsible because defendant S Thomas allegedly negligently conducted active operations on the premises and negligently trained and/or supervised their employees, invitees and subcontractors.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 but not more than $200,000 and all other relief to which he is justly entitled. He is represented by John Arthur Daspit and Lee S. Perez of Daspit Law Firm in Houston.
