'No instructions': Travis Co. man faults customization job on motorcycle for road accident

HOUSTON – A Travis County man is suing a local motorcycle parts dealer after efforts to enhance his motorcycle allegedly resulted in a road accident last year, recent Harris County District Court records show.

John William Filip’s suit indicates that the Lakeway resident entrusted his 1998 Red Honda GL1100 motorcycle to Power House Custom Cycles on Feb. 11, 2017 to add additional parts. The suit was filed on July 31 in the Harris County 61st District Court.

Filip recalls riding his newly-customized motorcycle northbound on FM 957 when he lost control, was ejected, “and his body slid across the roadway for a good distance before coming to a stop in the ditch facing west.”

Asserting mechanical failure, the plaintiff faults PHCC for failing to provide “any warnings or instructions regarding the extreme danger represented by the customization and/or additions to (his) motorcycle.”

“The only piece of paper that the defendants provided to the plaintiff when he purchased the subject additions was an invoice,” the suit says. “No instructions. “No warnings regarding the huge potential for injury. Indeed, there were no warning stickers whatsoever anywhere on or in the vicinity parts used.”

Consequently, Filip seeks unspecified monetary damages and a jury trial.
