Countersuit filed in case over property deal

Alleging fraud, tortious interference and slander of title, Dr. Yigal Samocha and Jacquelyn Samocha filed a complaint May 15, 2017 in Harris County District Court against Calvin Darbonne, Trey Lewis and Lewbonne, alleging they wrongfully filed an affidavit for a Houston property.

According to the complaint, the Samochas suffered damages for being unable to sell their Houston house, for loss of proceeds and money spent in preparing their property for sale and for having to pay a monthly mortgage payments to purchase a new home.

The plaintiffs allege the defendants failed to execute a written contract and failed to timely file the lien affidavit and to send a copy of the same to the plaintiffs.

On July 3, Darbonne and Trey Lewis filed a counterclaim against the Samochas, court records show.

The counter plaintiffs allege the Samochas misrepresented the condition and worth of the home they lived in at the time and made representations that never materialized.

Darbonne and Lewis contend they were forced to sell their property at a loss of  $420,000 because of the delays caused by the Samochas.

They seek actual, consequential and exemplary damages.

Houston attorney Ray Shackelford represents them.  

The Samochas seek monetary relief between $200,000 and $1 million, attorney fees and all other lawful and equitable relief.
