Pineda's Insite Painting Contractors employee seeks damages over injuries allegedly caused by ladder

HOUSTON – A Houston man is seeking damages from his employer after a ladder he was using allegedly slid and caused him injuries.

Roger O. Montoya filed a complaint on July 31 in the Harris County District Court against Rosalinda Martinez, doing business as Pineda's Insite Painting Contractors Co., alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 18, 2016, he was working in the course and scope of his employment with defendant when the ladder he was using slid and fell. He alleges the defendant had knowledge and/or constructive knowledge that the unsecured ladder posed a hazard and did not take any precautions.

The plaintiff holds Martinez, doing business as Pineda's Insite Painting Contractors Co., responsible because the defendant allegedly failed to follow safe practices and procedures to prevent the type of injuries that the plaintiff sustained.

The plaintiff seeks monetary relief of more than $100,000 but less than $200,000 and such other and further relief to which he is justly entitled. He is represented by Cynthia Frederick and Ronald Fitzgerald of The Frederick Law Firm PLLC in Houston.
