HOUSTON – A Harris County nonprofit alleges a restitution agreement was breached by two individuals that was created to address allegations of fraud and identity theft.
American Society for Kids Inc. filed a complaint on July 31 in the Harris County District Court against Alejandro Colbert and Monica Colbert alleging breach of contract and fraud.
According to the complaint, the plaintiff alleges that on Dec. 19, 2017, it met with Alejandro Colbert to discuss alleged fraud and identity theft. The plaintiff alleges the defendants stole its Federal Employment Identification Number (EIN) and used it to enter contracts and generate revenue from fundraisers that was never given to the plaintiff. The suit states it was decided in the meeting that restitution would be paid by Alejandro Colbert, as well as Alejandro Colbert would cease using plaintiff's name in any way and would close any bank accounts fraudulently opened using plaintiff's EIN.
The plaintiff holds Alejandro Colbert and Monica Colbert responsible because as of July 2018, the defendants allegedly have yet to close bank accounts that have plaintiff's EIN and company name and plaintiff believes that more fraud and identity theft are being perpetrated by defendants.
The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 and such other and further relief to which plaintiff is justly entitled. It is represented by Ross B. Reifel of Reifel Law Firm PLLC in Houston.
