Blueberries on HEB store floor caused fall, shopper claims

BEAUMONT – An HEB shopper alleges fruit on the floor of the grocery store caused her to fall and injure her hip and left shoulder.

Margaret Foreman filed a complaint on July 24 in the Jefferson County District Court against HEB Grocery Co. LP, et al. alleging negligence.

According to the complaint, the plaintiff alleges that on July 26, 2016, she was injured at defendants' HEB grocery store in Port Arthur when she slipped and fell on blueberries that had been smashed on the floor. She alleges she suffered injuries to her right hip, left shoulder and to her body as a whole as a result of the fall. 

The plaintiff holds HEB Grocery Co. LP, et al. responsible because the defendants allegedly failed to inspect the premises to discover latent defects and failed to give warning of any danger.

The plaintiff seeks damages within the jurisdictional limits of the court, plus interest, costs and any further relief to which she is entitled. She is represented by Jill Swearingen Pierce of Bradley & Steele PLLC in Port Arthur.
