Celina individual named power of attorney alleged to have failed to provide accounting after sale of house, vehicle

GALVESTON – A Celina woman is alleged to have wrongfully acquired money while acting as a power of attorney.

Billie Marie Utley filed a complaint on Aug. 6 in the Galveston County District Court against Vickie Lynn Berryman alleging breach of fiduciary duty, accounting, punitive damages and other counts.

According to the complaint, the plaintiff alleges that in June 2014, she signed a statutory durable power of attorney authorizing defendant to conduct financial affairs on her behalf. The suit states the defendant sold the plaintiff's vehicle and house and wrote numerous checks and has refused to provide an accounting of the money.

The plaintiff holds Berryman responsible because the defendant allegedly wrongfully acquired money and benefited from the fiduciary relationship with the plaintiff.

The plaintiff requests a trial by jury and seeks damages between $75,000 and $100,000 and any other relief, whether general or special, legal or equitable. She is represented by Keith A. Gross of The Law Office of Keith A. Gross in League City.
