HOUSTON – A plant worker is suing Lyondell and Houston Refining in response to a chemical release two years ago, recent Harris County District Court records indicate.

Derrick Ivey’s lawsuit, which was filed on Aug. 8 in the Harris County 152nd District Court, says the release from the defendants’ refinery at the Houston Ship Channel on Aug. 9, 2016 made him ill.

Ivey was working at the neighboring Kinder Morgan Export Terminal at the time of the subject release. According to the suit, nearly 600,000 lbs. of sulphur dioxide and 6,400 lbs. of hydrogen sulfide were released into the atmosphere.

Court papers fault the respondents for failing to issue warnings in addition to not addressing the purportedly dangerous condition at their facility.

Consequently, Ivey seeks unspecified monetary damages.

Richard J. Presutti of the Law Office of Richard J. Presutti in Houston serves as the plaintiff’s lead counsel.
