Woman alleges Rickman Transport failed to pay final wages

HOUSTON – A Gardendale woman previously employed by a Springtown company alleges it refused to pay her final wages.

Stephanie Homsey filed a complaint on Aug. 8 in the Houston Division of the Southern District of Texas against Rickman Transport LLC and Joby D. Rickman alleging violation the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a supervisor from April to July 2018. She alleges the defendants have refused to provide her with her final paychecks. She alleges that when she inquired why her wages were not direct deposited, Rickman told her it was because she made a report to the U.S. Department of Labor and that she would have to travel to the defendants' offices to receive her pay. She alleges the defendants refused to mail the check.

The plaintiff holds Rickman Transport LLC and Rickman responsible because the defendants also allegedly failed to pay minimum wages and failed to compensate her at a rate of no less than one-and-one-half times her regular rate of pay for each hour worked in excess of 40 in a workweek.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, plus interest, attorneys’ fees, costs, and such other and further relief as the court deems just and proper. She is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
