A Houston resident has filed a lawsuit following a severe injury at a local shopping mall, alleging negligence on the part of multiple business entities associated with the premises. Dalila Rios De Serna initiated the legal action on February 19, 2025, in Harris County District Court against BK Plazamericas, Ltd., along with several other defendants connected to the management and operation of Plazamericas Mall Texas.
The complaint arises from an incident that occurred on March 12, 2023, when Rios De Serna visited the Plazamericas Mall located at 7500 Bellaire Boulevard in Houston. According to the filing, she tripped over an exposed electrical cord on a walkway within the mall premises, resulting in significant injuries. The plaintiff accuses the defendants of negligence and gross negligence for maintaining a hazardous condition that posed an unreasonable risk to visitors. "The Defendants knew or should have known about this unsafe condition but failed to remedy it or warn patrons," states the complaint.
Rios De Serna's lawsuit seeks damages for physical pain and mental anguish both past and future, lost wages and loss of earning capacity, physical disfigurement and impairment, medical expenses incurred and anticipated, as well as exemplary damages. The plaintiff is demanding monetary relief exceeding $250,000 but not more than $1 million. She further asserts claims under doctrines such as respondeat superior and agency, holding the defendants vicariously liable for their employees' negligent conduct during their employment scope.
The case is being handled by attorney Kraig L. Rushing from his Houston-based law firm. The presiding judge for this matter is yet to be named officially in public records under Case ID 2025-11360 in the 165th Judicial District Court of Harris County.
