Enterprise Marine Services employee alleges he was injured while working on vessel

HOUSTON – A seaman alleges he was injured while working on a vessel and that his employer has failed to provide maintenance and cure benefits.

Gerardo Garcia filed a complaint on Aug. 13 in the Harris County District Court against Enterprise Marine Services LLC alleging willful and wanton misconduct.

According to the complaint, the plaintiff alleges that on May 17, he injured his back while in the course and scope of his employment with defendant while doing a very heavy manual lift. He alleges he suffered severe bodily injuries resulting in pain and suffering, mental anguish, impairment in earning capacity and medical expenses. 

The plaintiff holds Enterprise Marine Services LLC responsible because the defendant allegedly failed to provide adequate equipment, failed to have properly trained personnel directing his work and failed to provide maintenance and cure benefits.

The plaintiff requests a trial by jury and seeks damages of more than $1 million, plus interest, costs and such other and further relief to which he may be justly entitled. He is represented by Anthony G. Buzbee and Christopher J. Leavitt of The Buzbee Law Firm in Houston.
