Mother of children killed in Port Arthur apartment fire files suit

BEAUMONT – A mother of three children who died in a Port Arthur apartment fire on Independence Day alleges the property's owner and manager did not keep it in compliance with applicable fire and other codes.

Tikeshia McCray, as next friend and personal representative of her minor children, Brooklynn, Brayden and Jayden, deceased, et al. filed a complaint on Aug. 2 in the Jefferson County District Court against Arthur Square LLC and Capstone Real Estate Services Inc. alleging negligence.

According to the complaint, the plaintiff and her children were tenants at Arthur Square Apartments in Port Arthur, which is owned by Arthur Square LLC and managed by Capstone Real Estate Services Inc. The suit states on July 4, plaintiff's three minor children were unable to escape from a fire at the apartment and were killed.

The plaintiff holds Arthur Square LLC and Capstone Real Estate Services Inc. responsible because the defendants allegedly failed to ensure the plaintiff's apartment was equipped with fire suppression equipment and properly functioning smoke, fire and/or carbon monoxide detection systems; and failed to comply with applicable codes and other standards.

The plaintiff requests a trial by jury and seeks damages within the jurisdictional limits of the court, with interest, costs, attorney's fees and such other and further relief to which she may be entitled.
