HOUSTON – A Spring consumer alleges a Michigan company keeps calling him by mistake.
Antonio Cardenas filed a complaint on Aug. 16 in the Houston Division of the Southern District of Texas against Quicken Loans Inc. alleging that the Michigan business entity violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that within the last year, the defendant has been calling him in an attempt to reach another person. He alleges he spoke with a representative multiple times to inform the defendant it was calling the incorrect number but the calls continued.
The plaintiff holds Quicken Loans Inc. responsible because the defendant allegedly continued to place calls using an automatic telephone dialing system and/or using an artificial or prerecorded voice and despite knowing that it lacked consent to do so.
The plaintiff requests a trial by jury and seeks statutory damages of $500 for each violation, treble damages for each violation determined to be willful and such other and further relief as may be just and proper. He is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
